My fiancee has overstayed his work visa. He's from Jamaica we are getting married and want his family from Jamaica to come. If I send them a letter of invitation and state I want them to come for our wedding will they run his name and issue a deportation notice? The wedding is in June
 
Well, they will have to list him on the application and his current address. They might check, they might not. How long has he been out of status?

Also what do you mean they have to list him? If I'm sending the invite they need to still list him? Because he's had a visa at one point or because he's the groom? Can I write a letter without using the wedding as the reason? Can I not just invite people to come visit?
 
The application requires the applicants to list all family members and the current address (IMM 5645) If they don't list him, or lie about his address, it can have serious repercussions. You can invite them with whatever reason you choose, but they will need to show they meet all the requirements to obtain a visa. Have you thought about how you will register your marriage? There might be some pitfalls surrounding that with his current status.
 
Hmmm ok .... yes the marriage license is no problem in our province. No citizenship or immigration status is needed. I guess they might have to miss the wedding.... that sucks :'(
