Hi,

Can anyone help with a question I have regarding IMM008E. I'm applying for common-law inland and applying for the open work permit etc. The guide gives this information to help with which classification to apply for:

Apply under the Family Class if:
  • the person you want to sponsor lives outside Canada
  • the person you want to sponsor currently lives with you in Canada but doesn’t plan to stay in Canada while the application is being processed
  • you plan to appeal if the application is refused
Apply under the Spouse or Common-Law Partner in Canada Class if the person you want to sponsor:
  • lives with you in Canada
  • is eligible to become a permanent resident from within Canada
  • would like to apply for, and qualifies for, an Open Work Permit so that he or she can work while the application is being processed
Now this is quite clear which category I should apply under as i'm in Canada therefore I want to apply as Common-Law partner in Canada Class but my problem is on the form IMM008E it doesn't give me this option to apply. The only relevant option that I can apply under is Family Class and Common-Law.

Can anyone shed any light on what I should put in here. I'm assuming family class as its the only relevant option but I don't want any delays or issues in applying and i'm expecting to send the application in the next few days.

I don't quite 'get' what your question is.

If I am reading this correctly, you seem to want to know how and where it is that you specify that you are applying inland vis outland?

If so, then you do this on the checklist (not IMM0008). It is all in how you answer the 'magic' three questions under the 'Sponsored Person' section, Item 4. See here:
