My friends study permit expired last November, unfortunately due to miscommunication she was informed by the college authorities, that she could do it later on while extending her permit (work).
She knew this about this a week ago,but has exams and is graduating this April 2019 .
I know that you need to leave Canada at any cost .
My only concern is her exams,is there a possibility where she could only finish her exams and return back ? This is her last semester, her future could be jeopardized.

Regards,

Unfortunately, nothing can be done at this point. There is only 90 days window period after permit expiration where you can apply for restoration which in this case has already expired. Your friend has to leave the country ASAP.

She is technically studying illegally without a permit, what college would suggest such a thing! No option but to leave.

Thank you . I have informed her about the situation .
Also can she apply for an open work permit from home ?
Is she still eligible ?
What is the next best step to take ?
Since she completed a 2 years course, and her PGWP is still applicable ? Or has she lost every opportunity to come back, after not abiding the laws .

If she has graduated then she can give it a try to apply for PGWP.

Try to get a reference letter from college which would explain what happened in regards to expired study permit, it might help. Although it’s your (as in temporary resident) responsibility to maintain legal valid status during stay in Canada.

Regardless, when applying for PGWP - she should provide brief explanation about this.

You have 180 days to apply for PGWP from the date you receive confirmation of completion. To apply for PGWP from within Canada you need to have valid status. So her only option is to leave and try to apply from abroad.

Thank you for your help .
1. Thing is to go home and apply for the PGWP.
2.is she still capable for an open work permit ?
As,in can she apply through the same status that she is ? Or she needs to make a new profile ?
3 how long could this process take ?
The situation also depends on the immigration officers right ?
And what does she need to do before she leaves Canada ?
To ensure everything is right ?

A PGWP will most likely be denied - but she should try applying all the same once she leaves Canada. One of the requirements of a PGWP is that your studies were completed in Canada under a valid study permit. She obviously hasn't done this. I would recommend she complete her studies in Canada without status, leave and then try applying the PGWP from her home country. Most likely a refusal - but worth trying.

Thank you .
Even if she tries for another course from India . It’s likely to get denied right ?
So there is no best option but to go back and forget about coming back to this country right .
I am just making things sure, I don’t want to give her any false hope .

It's hard for any of us to say if she would be approved for another course or not.

Thank you .
I’ll let her know.
Does she need to clear all her bank accounts and close up everything, in short clear her profile before she leaves ?
Also, thanks for your help . If there is any other source like a sponsor would not be able to help as well, I suppose .
Should she visit the immigration department before she leaves ? And inform

What is the procedure to go back home?
She wants to go legally . Even if that takes to inform the immigration or pays certain fine for her overstay ?
Any information on this will be helpful
