Hello,

I have recently married my jamaican husband who is residing in Jamaica with his 5 year old son. I will be sending in my sponsorship application shortly however, I am not sure how to go about bringing my stepson over at the same time. There are no legal documents giving my husband full custody although his son has been living with him full time since birth and barely has contact with birth mother. Not sure whether I should adopt (and how long this would take) or if my husband should go seek legal custody in court.

What are you thoughts?

Second, if your husband has no formal arrangements regarding his son's custody but the child has been in his exclusive custody, he should seek custody through the courts. In order for him to remove the child from the country, CIC will either require the permission of the non-custodial parent OR proof of sole custody.
