Help! Somebody!

Ok, long story short

I have an outland application, I am being sponsored by my canadian citizen husband. Our visa office was supposed to be Ottawa.

Over this week I found out that our application ended up being sent to Los Angeles.

I've ordered my case notes, and am waiting to see why. . . . but I have taken a hint from something someone said and I believe my Mother in Law, who hates my guts completely called in and reported our marriage to be fraud. I'm not positive that this is what happened, but in the past she has said she would do whatever she could to get me away from her son and wishes she could get me deported.

Seriously what do I do now? Just wait it out and see what my case notes say, if it is a huge flag because of this stupid situation what do I do?

Thanks for any help. I seriously am so shaky and upset right now. I really hope that this was just a threat and not a reality because I might lose it on her if she has ruined everything for us like this.

Ok calm down. From what i have heard through this thread they don't take much notice of people being evil . For now just keep as much evidence as possible .Any way you are from the US if i recall rightly .I can't see Cic thinking its a fraud marriage. So sorry that you have one of those mother inlaws.

Well it won't be a big deal, you might get an interview to address the accusations, but since her claims are false and she has no proof other than a poison pen letter, you should be fine. If you guys are not doing a marriage of convenience, then it's not a big deal because your mom in law has no proof. It's only if her proof is extremely solid and concrete that your PR application can be refused without even getting to the interview.

Not really, I've calmed down over the idea that this is a possibility of what happened, but I'm still stressed and filled with anxiety.

LA has a processing time of 26 months, with that on top of the family issues that we continue to face here in Canada, we've both decided that living in Canada isn't going to be what's best for us, and we've chosen to cancel my application and start the process to immigrate back into the United States.

I am sorting out my house here in Canada just in case my husband don't get approved, and i have to l go back to the U.k , its where i am from, but have been in Canada 28 years . My husband is also sorting his house too, just in case he gets excepted for Canada . Its a nightmare being in so much turmoil .

Wow you are a very strong woman to make that decision to cancel the PR and live back in your home country. Even better that your husband is supportive of your decision and you both mutually cancelled the PR. Even though I disagree with you having to cancel the PR so soon, because as I mentioned earlier, your mom-in-law has no proof, kudos to you for doing what's best for yourself.

Remember that 26 months is not an average time, it's more a worst case time. According to actual stats from LA, 50% of apps (so closer to "average") are done in less than 15 months. 20% of cases are done in less than 10 months.

You could also have the app continue processing while you are living in the USA. Then when PR is eventually approved, you can make the decision then whether to stay in US or Canada. You could also look to move elsewhere in Canada away from your in-laws. Of course nobody knows your exact situation, but you should choose to live based on what country will give you better opportunities and lifestyle, not just to run away from 1 person!

At this point, the USA is going to be a better option. We're both young, still working on our educations and with the turn of events here with my husbands whole family and the immigration and education stand stills it's just going to be easier.

Thankfully my mother is very politically active and has good connections so the process to get into the US will be faster anyway

Hi Rob - out of curiousity, any idea as to what the "real" wait time for NY is? My one concern is that before we were married, i received an exclusion order from canada, so i was inadmissible to enter the country from dec. 2011 to dec. 2012, and it's unclear if our app will be kicked over to NY. my hope is now that we are married, it's been over a year, and i've crossed multiple times since, it won't be an issue. it'll be nice to know whether NY is truly a 2 year wait. fingers crossed we get sent to ottawa!

I wish it was only my mother in law that was the issue, she is just the one really hateful enough to ruin my chances of getting into Canada if she wanted to. No one has married into my husbands family in well over 20 years, there is just too much dysfunction, his family continues to try and split us up because they don't understand the concept of marriage and working together and it's putting my relationship with my husband in harms way every day so that's just not flying well anymore more with.

My husband is a bit disappointed, as am I, we had a lot of plans for us in Canada and it's hard to have to let go of those dreams. But with moving back to the USA and being close to my family who love my husband so much and would do anything for us, will make the immigration process much easier there on top of a short processing time thanks to government connections.

We haven't canceled my application YET, there is a small chance we might proceed with my application in Canada, but only if a miracle happens which I don't foresee.

There is no problem letting your PR app continue processing in LA while you also immigrate to the USA. Yes, she can continue the process of her application and wait and see... and get her PR in Canada... but once she has it she need to prove that she has valid reason to stay out of Canada otherwise the time that can be outside is something like 6 months a year, if exceeds that time the PR gets revoked. Longer time is allowed with a Return Permit that can be obtained at the Canadian Immigration office of the Consulate..... Once you get your Canadian Citizenship then its another story... you can stay away all the time that you want and always Canada will be home... Until the law is changed.... and it can easily happen...

That is completely wrong. That is only for keeping US green card, which has nothing to do with Canadian PR.

The basic rules for PR obligations is to reside in Canada for every 2-out-of-5 years. A PR could easily stay outside Canada for 3 straight years, and re-enter no problem to meet the final 2 years to maintain PR status.

Or in this persons case, as long as she is living outside of Canada with her spouse, there is NO RULE about residing in Canada. She could live outside Canada for the next 20 years and as long as she is living with sponsor, the time counts towards PR obligation rules.
