My fiancee began the application process last year and has now been asked to submit her passport as her immigration visa appears to be ready if here has been no changes to her family configuration. As at the date she received the letter and sent in her passport there was no change so there is nothing to report. Her passport has not been returned yet.

But we had scheduled our wedding for 10th March 2018, if we go ahead with the wedding on 10th March, which we scheduled even before she got the email, then there is now a change in family configuration as at 10th March which I believe she is bound to report ASAP even if the visa has been issued or not. From my research(i may be wrong) the obligation to report any change in family configuration is only extinguished when she lands in Canada as she is now deemed to be a PR as soon as she lands and the option open to her at that point is spousal sponsorship.

what I need to be certain about is what happens to her application if she reports the change maybe on the 11th of March when we must have in our possession the marriage certificate? From my research her application is put on hold while I'd now be required to submit my medicals and police report and this process takes a maximum of 5months(is this correct )? We are both comfortable with this but if my application will jeopardize her chance of getting PR in any way I'd rather we postpone the wedding till after she returns from landing in canada to pick up the card. Then she applies for spousal sponsorship for me.

I am trying to avoid a situation where we get married on the 10th, don't inform the CIC then when she tries to apply for spousal sponsorship after she lands in Canada they might flag the application saying that there was a material change in her family configuration before she landed in Canada and she failed to inform the CIC.

Has anyone faced anything similar and what is the way forward? Thanks.
 
It's really simple. If you get married before she lands in Canada and becomes a PR, the she must return her PR visa, notify IRCC that she is now married and submit all of the paperwork to add you to her application. If she fails to do this and lands without notifying IRCC, that misrepresentation. There will be two consequences. The first is that she will never be able to sponsor you. The second is that IRCC may revoke her PR status.

If you don't wish to go through the process of updating her application and adding you to her application, then the only alternative is to get married after she lands in Canada and becomes a PR.

I'm assuming you've never lived together - or if you have lived together, it's been for less than a year. If you have lived together for a year or more, that will change the answer.

Thank you for your response. Yes we have lived together but for less than one year. Do you know how long the process of adding me to her application would take to conclude ? And what this process entails?
