hi I have a pending petition under conjugal partnership, I know what are are the odds are :-(

the problem is that my sponsor or we are experiencing financial problem and she is thinking of resorting to filing bankruptcy, would this affect my petition??? thanks in advance.

I don't think u can sponsor anyone when you file bankruptcy, why not try consumer proposal.. That would help.. Its under the same bankruptcy company, bt its not bankruptcy. They will put everything u owe and u do a small payment monthly... If this helps!!
 
Your sponsor would be disqualified if the bankruptcy is filed before your application is processed.

Bankruptcy, in and of it self, is technically not the problem, but it must be discharged ( which takes typically 9-21 months, depending on the circumstances for a first time filer) at the time that your application is in-process.

Ideally, she should do whatever she can to defer the bankruptcy decision until you have PR.

I agree with lovindahubby. Try the consumer proposal route if most of the debt is unsecured.

btw, can we consider filing bankruptcy as a social assistance? because its the term used in the cic website that disqualifies you from sponsoring a person right? and we know a person who filed and was still doing some payments. so its technically not a social assistance, what do you think?

I am not sure what you mean. There are several things that can disqualify a person from being able to sponsor. Start reading at section 5.28 and all the items in table below bar someone from qualifying as a sponsor.
