Dear Sir, My name is gurjeet and I want to ask your advice regarding my PR option. I am from India and I got married couple of year back. My wife has dual citizenship of India and canada. After marriage she sponsored me for PR but after few month we started having problems in our relationship and she withdrew the application. We have lived physically together for only one month after marriage and after that we didn't see each other. We have not talked to each other for a year now. Our relationship is over but We haven't filed for divorce because she neither want to be with me nor she wants the divorce with mutual consent. I did sent her 3 notices from court (under section 9 of hindu marriage act) asking her for continuation of Marriage life (just for my security if they blame me for breaking of relationship later on). She didn't recieve and didn't respond to any notice so court passed the one sided decision in my favour saying that I want to make relationship work but she doesn't. Now, I am planning to apply through other modes (express entry most probably). Basis my education, work experience, language score I am getting about 420 points. My questions are - 1) will withdrwal of my previous PR file by my wife affect my express entry file also ? 2) they ask to provide marital status. Which i have to answer as 'married' as we are not legally separated yet. In this case will they ask me to submit any documents of my wife alnog with my wife. Because she is not going to provide any information. She would rather try to make it even more worse for me to apply and get PR. So, how should I approach on this? 3) what if she files for divorce in between? Can I fight the divorce case and apply and get visa at the same time. Or will I not get visa if case is going on?? Kindly advice!

1. Withdrawal should not have a problem. It isn't as if your visa was declined or your file was rejected.

2. Yes, you need her information (not sure what in your case since she is Canadian) but in normal conditions you need the spouse details as well.

3. I don't think it should have an impact to have an ongoing mutual consent divorce case. It is not a criminal case. Unless the case is not mutual consent.

But in the light of 2 above, I think you should speak with a proper immigration lawyer based in Canada (not India based) to help you.

1. No it should not hurt your case.
2.You can provide them all the documentation you have and tell them you have nothing to do with her. They see a lot of sadists like her. Do not worry too much about this. It will not be a big factor. She is a Canadian Citizen anyways. So Immigration would not scrutnize her much in your express entry case.
3. You should not worry too much about it at this time. Keep it confidential that you are applying for Canada and if she comes to know about it. Be ready for her to make your life a living hell. You can keep the information confidential for a year. That will help you very much. She will not be able to hurt you much unless you let her do so.
