Hi there. My husband and I are planning to submit our spousal sponsorship application (I am a PR in Canada) to the HK office in Jan 2014 and he is coming to canada in Feb to stay with me while we are waiting for the processing. My husband wants to work in Canada during his stay but he doesn't need to apply for a temporary resident visa when he comes to canada. Can he apply for the open work permit? Or he has to apply for the closed ones? We have applied the open work permit twice outland but our application got refused because they said that he is not eligible. Thanks for answering my question.
 
He will only be eligible for an open work permit if you apply to sponsor him inland (from within) Canada. If you apply inland, he will qualify for an open work permit once the application has AIP/first stage approval. It's currently taking 11 months to receive AIP from the time the application is received.

If you apply outland (as you have planned), then no open work permit is available to him. If he wants to work before he has PR, then he'll need a closed work permit. To apply for a closed work permit, he'll need a job offer from an employer and an approved Labour Market Opinion from that employer.
