I have overstayed in Canada for 11 years, I was in an abusive relationship with my "x". After applying for an extension and several visits to the cbsa office, My passport expired along with any other documents pertaining to My status. The threat of never seeing my son again and being the Stay at home Father providing my son with a safe environment as well as the Step son, Immigration suddenly arrive at my door with police arrest and detain me. I did work after being forced out of my home. Threats of attempted rape created that. The miraculous loss of all my papers. I actually phoned the police 3 times about her abuse. I now face deportation. Yes i worked occasionally from October 2014 I was homeless and still needed to give my son a safe environment. I am a good father and has fought my way to a secure position and was seeking immigration help through several Winnipeg centres without success. I approached several abuse organizations.
As a Male its difficult to claim abuse. I could of easily gone home in October, but fought through many obstacles to ensure my son has a father. Starvation at some points to ensure i had a means to allow him a respite at weekends. Lawyers want 5,000 in retainers, impossible !! when you are just surviving to do the best for your Child.
I am at a loss. I have a lawyer but they seem to be a little unsure of themselves. My son lives not to far above the basic needs for cfs to be involved I cloth him, I pay his childcare, I provide him with security at weekends. He is now 8 and left open to a woman who has the most ridiculous notions of how a child be raised. I need any help and advice to be able to stay in Canada for my sons well being.
As it is my "x" was the only person who knew my house address and after not being deported immediately, is now seeking to use my son as a pawn claiming he needs therapy after visiting me. Its a mess I'm indebted to friends and the help is overwhelming. I am skilled from the UK in masonry work.

Your situation is certainly quite complicated.

Based on the information you have provided, it sounds to me like your only hope of remaining in Canada is to file a Humanitarian & Compassionate (H&C) application. Application details can be found here: http://www.cic.gc.ca/english/information/applications/guides/5291ETOC.asp

Unfortunately I have no idea what your chances are of being approved.

None of the economic immigration streams (e.g. federal skilled worker) are viable for you based on your immigration history. It really does look like H&C is your only option.

Good luck and I hope things work out for you and your son.
