Dear Rose
To be very fair & straight;
If you love your child , and wish her to have a wonderful life ,

1.) In first place include her as accompanying child with you
2.) Meanwhile file legal suit for her guardianship , courts in India issue these Guardianship certificates with in 8 months
3.) This is simple solution
If you want to throw this baby as a piece of used tissue or useless object , don’t mention her in your application.

Kind Regards

If you were never married, then you do not have a husband. It is as simple as that. In the place where you have "MARITAL STATUS" keep it "SINGLE".

In Canada, USA, UK, Asutralia; they are many single parents who are unmarried but has children. So, Canadians will understand the matter that you are unmarried, but you have given birth to a child.

* If you want to take the child to Canada, then mention her name in your application.
* If you do NOT want to take the child to Canada, then do NOT mention her name in your application. But, in this case you cannot add her name to your list of children in the future.

In many forms they might ask for your spouse's information. Since, you are unmarried, so just leave them blank.

Thank you all for your useful replies , I just want to mention that in all cases i will mention her in the application , however she will not accompany me in my first travel to canada ( In case my application is approved ) , my plann is to bring her with me after 6 months from my landing ( hopefully ) , i will never abandoned my child , what i care about now is : how to submit a complete application when i dont have access to teh father to fill the Separation Declaration for Minors Travelling to Canada [IMM 5604] (PDF, 21 KB) ),
Thank you all for your help,

I suggest you to include your child name to accompany you ( the child can land after sometime - say 6 months).

It is not necessary that all the applicant has to land together.

Secondly if you are not married, why you need to fill Separation Declaration for Minors Travelling to Canada [IMM 5604]..? I am not clear for this

Thank you all,
Coolguy: as i undreasood from the application guide , if the other parent of a child is not included in the application , then this form need to be filled and signed by the other parent ( who is not included in the application), please correct me if iam wrong,

A child without marriage DOES NOT mean that only the mother has rights to take decisions for the child. Unless there is some legal arrangement between the parents that allow the mother to take ALL or certain decisions for the child without the consent of the father, the father has to approve of important life changes such as immigrating to a different country. And as such, the OP would need to get the declaration form filled by the father, married or not.

Out of wedlock child DOES NOT exclude either of the parents from their rights or responsibilities, only legal arrangements can. Hence, it is very unlikey that a single parent would be able to take her child outside the country permanently with her without the consent of the father. I would suggest the OP to seek legal action. May be she can get a lawyer and try to get the father to respond to her?
