Hi, I applied for a Permanent Residency through Provincial Nominee and included my wife and her first child with another man as my accompanying dependant. We have received our visa and Confirmation of PR last February. The only step left is for me to land as I am in Canada and my wife and her kid is in the Philippines.

Now my situation is, my wife and I decided to separate and I have updated CIC about the change in my marital status as required in the confirmation letter sent to me. Now I am waiting for their reply, I would just like to know if this will affect their ability to come here to Canada as basically I am saying that we are separated and I will not be supporting her. I have no problems with her coming here to Canada but my main concern is if I still have to support her if CIC does decide that they can come here. I was told that as long as we have not received our PR Card yet then I can still change it. Would it be better for me to withdraw them on my application or will CIC consider for them to come here to Canada but I will not be resposible for them? And how do I withdraw if I choose to and which is the best department of CIC should I contact regarding this matter?

Thank you very much.

What information did you provide to CIC to prove you have separated? To remove someone from an application, CIC typically requires proof you have legally separated or that you have started the divorce process. In other words, they are looking for legal paperwork. An email typically isn't enough and won't be accepted.

As far as CIC is concerned, you haven't done anything to formally remove her from your application.

I would say, complete the landing for all of you and work out a separate procedure where she attests that she won't ask for support from you, until your separation is legal.

I have successfully talked to a CIC agent the other day and she said that technically our confirmation letter is invalid now as I have updated our status as separated. She had advised me to request for their withdrawal as there is no sense in bringing them here because Canada will not see the point of them being my dependants as we are already separated. As for your question though, I have written them as follows:

" I am legally required to update you of any changes in my situation thus I am letting you know that my wife and I agreed to separate on this date. If you need supporting documents I am willing to provide them. And I fully understand that in updating the specified changes that you might revoke their visa and confirmation of PR. Please advise me on the next steps I should take and how to proceed from here.."

Do you thinkI should write to them again with the supporting documents? Or should I just do as the agent says and withdraw them? I am not oppose to having them come here. But I will not support them for 3 years if they do come here.
