Hi,

Can some one clarify the question “Have you been working full time for the employer on your current work permit for at least one year?

I’ll be going back to Canada on a young professionals visa next month. It will be valid for 12 months. I have previously worked for this employer for 22months between 2017-2019 on an open work permit.

Can I use the previous employment as part of the 12months or does it have to be continuous? I understand if I had gone straight from open to closed work permit it would count but what about with a gap of two years?

If I wait until the 12months, my visa will have run out and I won’t be able to get the extra 50 points for job offer.

There isn't a clear answer to this question to the best of my knowledge and you may want to hire a lawyer.

This question has come up a few times in the past. However I don't think we've ever had anyone come back to report what happened to them. Maybe someone else will confirm that or knows otherwise?

The wording of the statement includes "current" and the requirement is that you hold an employer specific work permit. By that logic, it would indicate that you must have worked on the closed work permit for at least a year to qualify for the 50 points and the time spent on the open work permit cannot be counted towards that one year. But it's hard to say if IRCC will look at it that way or give you credit for the time spent on the open work permit.

Don't bother calling the IRCC help desk with this question. They are unfortunately useless for all but the most basic questions.
