Help deciding Backup Options

Hey guys

I need help from the community here.

I am currently in US and work for an Indian MNC. My Student Visa ended in Feb 2022. My company applied for work permit in Canada and it was an ICT GSS application. There have been lot of delays in the process. Although my Student visa ended in Feb 2022, my WP application was filed only in May 2022.

In July 2022, Ic was asked to resign since they could not extend my leave with pay since there would be compliance issue for the company. However, I was told that I will be rehired in India and then transfer me to Canada. I did not have any option other than resigning because If I did not then Would have been terminated which would complicate my rehiring.

Finally, In Aug 2022, I got my approval and 2 weeks later I got my visa on my passport. Now comes the challenging part. Since I got my Canada WP, my Manager said that instead of India rehire, they would start the process for rehiring in Canada. The process has been started but its very very slow. My manager asking me to start looking for backup options incase the Canada rehiring doesn't happen. This has freaked me out because I have been without salary since Feb 2022 waiting patiently to go to Canada. Since I don't have US visa anymore, I will have to travel back to India which I don't want to.

Please suggest me what to do and What backup options can I have here?

Note: My stay in US since Feb 2022 is completely legal. I have an attorney hired who is making sure I stay in US Legally.

What do you mean "rehiring" process in Canada? Isn't this an issue with your employer and not an immigration issue at this time? You have to decide whether to stay in the US while you wait for your company to figure out their next steps for hiring.

This is very confusing since as an ICT you should be working in the US or elsewhere in order to be able to transfer to Canada. It sounds as though your employer may not have indicated that you were no longer working for the company in the US or may not have updated your application which would mean you were granted an ICT based on misrepresentation. You need to follow-up on your situation because it is still your application for ICT. You don’t want to misrepresent your situation.
