Help ! Appeal after sponsorship refusal for parents' permanent residence application

Hello all,

I had a step brother that refused to complete medical exams for my parents' PR application, after many trials, we received a Procedural fairness letter. We replied with Statuary Declaration from me and my mom( primary applicant) stating we will never sponsor him to come to canada, and detailed letter of us trying to contact him. A couple weeks after, we received a refusal letter because of no medical exam of his.

Can everyone give suggestions on whether we should appeal? how successful will it be? Should we represent ourselves or should we hire immigration consultants? how to succeed on appeal?

Really appreciated all your suggestions!!!!

Think there may been even more concern due to the fact that your brother is adopted. Unfortunately there are some families who treat adopted children differently.

My adopted brother estranged himself from the family a few years back, and he will be 21 years old in a month. He is mature enough to make decisions and will complete college in a year. We tried many ways to contact him but he did not reply. So we had no choice but statuary declaration.

We are not sure if the concerns you mentioned will affect the result of appeal?

Have you tried to get him to sign a notarized document saying he is aware that he will never be able to be sponsored?

Yes we did. We sent the letter by Courrier, mail and email. He rejected the Courrier and mail, and didn't not reply the email. We submitted all his rejections to IRCC but still refused. It almost seems like the IRCC ignored all the materials we submitted.

IRCC doesn’t like to not include young people especially when their whole family is moving to Canada. It has major repercussions and young people can be temperamental. Have you suggested that if he does a medical and sign a few papers you agree to leave him alone.

If you want to appeal, you'll want to do it with the assistance of a good Canadian immigration lawyer. I don't think any of us can comment on the chances of success.

Yes we did. We sent emails, text messages but he never replied back. There was nothing else we could do. And we mentioned to IRCC about all our effort to try to get in touch with him .
