Not until after Friday... I believe that katester is confirming my initial question I had. Just because you are applying inland doesn't mean your spouse is automatically allowed to stay in canada while the application processes. You still need to have a valid visa of some sort or the spouse could get kicked out and your application would essentially be thrown in the garbage.

i believe if an open work permit is submitted with an inland app, the applicant will have implied status? also, there are some conversations on this forum about whether or not cbsa goes after inland applicants who don't have implied or legal status. it seems they don't put the time, effort and money to deport pr applicants. i'm not saying to do it, i'm just saying to remember there are 2 agencies involved, and they don't necessarily keep each other up to date about current legal status' of the applicant.

Kim, if i were you, i would apply outland. your partner is from France - the Paris VO is very fast (6-7 months compared to inland 18 months)

Oh wow!! Our lawyer told us to do inland! It hasn't been sent out, we will send it out next week but now we are thinking of doing it outland! Thank you all so much for the feedback it's so appreciated.

Would he have to go back to Paris to do outland? I'm not sure how the outland works. I'm sure there is a thread on here. I will look and research!

Thanks again! :)

Kim, stop listening to that lawyer :o

outland is more indicating that your application is processed outside Canada. definitely choose outland - watch out, there are different checklists for outland and inland.

so apply for a extension for your partner , tell them you want to file a PR application (paying the fees before and showing them the receipt would greatly help!). your app will be processed overseas but your partner can wait in Canada because she's from a visa exempt country AND has status as a visitor.

good luck to you! :)

another question ... when we apply outland can we still send in the open work permit application?

no, outland applicants are not eligible for open work permits. the applicant may work remotely for a non-canadian company while in canada as a visitor during the processing.
