Hi,

I would like to enquire about my case especially on my PR eligibility -

To give you a background about myself, I got married in 2013 in India and went to Canada on a dependent PR in May, 2014 and stayed there for about 9 months.
Unfortunately things didn’t work out very well with my husband and I came back to India.

Currently there is an Business Travel opportunity for which I might have to travel to Canada and thus have the following questions.

1) Is my PR still valid?
2) If not then can I apply for Business Visa?

Please note that technically I am not yet divorced as per Indian law and our separation is currently in-process.

When you say "dependent PR", I'm assuming your husband applied to immigrate to Canada through an economic immigration stream and you were included as a dependent in his application. If so:

1) Yes - still valid.
2) You would have to officially give up your PR status before you can apply for a Business Visa

Thanks for quick Response !!

Yes ,My husband sponsered me to immigrate Canada .I read some where rules has been changed for sponsered PR card holder from 2014 I guess and both should be in marriage for atleast 3 years then only my PR will be valid ,Is that's not the case ?

No, there is no such rule. Your PR is valid as long as you meet the residency obligation of spending 2 of every 5 years in Canada. Your relationship with primary applicant is irrelevant.

Is there any Canadian Govt Site where i can check my PR Status before travelling ? I want to be sure that i should not deport back to India

nope there is no online website

If you call them they might take it as suspicious.........

if nobody has informed Immigration Canada about your status then there is no problem

if you wana come you should give a try, i dont think they will deport you right away.

Its 50 50 chances either they will inform you about circumstances and let you give a chance to explain

OR they will let you IN.

if your ex is not married yet (if you find out this) and he has not filed Divorce here in Canada, then there are chances that your PR is still active.

Senior can further comment better,

What are you talking about? There is zero chance PR status has been taken away. As explained above, the separation from spouse is completely irrelevant to her PR status.

As long as she meets the 2 in 5 years residency obligation (which she does if she got PR in 2014) then her PR status is still valid and she can easily fly to and enter Canada with her valid PR card.

He PR status will only be in jeopardy once she no longer meets the RO by spending 3 years outside Canada out of 5.
