Have I legally residing in Canada for at least 12 months immediately?

Hi all,

I am sorry that the title might seems like non-sense, but I am confused about this. I appreciate any helps.

My situation is, I graduated in canada in 2008.12, and got a 3 years open work permit starting from 2009.1.

I have been working for a canadian company in canada since 2009.1 to now, however, because I got 3 weeks vacation days last year. So I left canada for 3 weeks in last December.

Now, I am planning to apply for permanent residency under federal skilled worker class, my worry is, because I left canada for 3 weeks last year for vocation, however, I got paid for that period, and the pay cheque I got shows I was still working for the company during that period. Therefore, would I still be considered as legally residing in canada for at least 12 months immediately? Or would the office consider my residing in canada had been interrupted when I left canada for vacation last December?

I am really confused about the term 'residing'. Does it mean if I ever left for vacation, I won't be considered as 'residing'?

I think you will still be considered residing however you were on vacation.

Thank you barsindoo, I think I will at least send out the application, as they will refund me if I am not qualified to process anyway.
Plus, I am also qualified for CEC. Therefore, I would like to apply under both classes, just to be safe if ever canada changes its policy in the coming future.

Save your money and just apply under CEC. It is faster than FSW and a lot more straight forward. For FSW there is a complicated points system and for CEC, either you qualify or you don't so it's a lot simpler.

Thank you very much for your suggestion leon, however, do you think whether they might cancel the CEC class in the future?
In addition, I am also worried that because more and more people are going to apply under CEC, there might be backlog in the coming future...

If you have already applied, it will not affect you if they cancel it in the future. Go to trackitt.com to look at the timelines for CEC and FSW. CIC has not posted any timelines yet but they probably will soon.
