I don't think this stops you from coming to US on H1, you just have to come where your employer requested USCIS to grant visa.... If your employer has approval for NY then it's ok to land in NY... My 2 cents.

It is basically employee-employer relationship.
 
I don't think this means the American dream is over. It merely is a way to cut down on employers who have been abusing the system. It may not be the best way but it is their method. This is not different from India's new rule where if someone leaves India, they cannot enter India for another three months. Imagine a foreigner working in India, leaving to Sri Lanka for a holiday, cannot go back. Or even someone on holiday to India and then to Nepal, cannot go back to India to catch their return flight.
 
You can still enter US, just at the right place. I don't think anyone should be scared to come to the US with the fear of deportation, as long as the rules are applied. With the current increase in threat perceived by them, they are being extra cautious I suppose.

I agree, American dream is still live and you can get there if you have the guts.
Immigration rules can be strange.......

but the rule (expedited removal ER) that person can not re-enter US for 5 years is not understandable.

If person with genuine H1 B visa need guts to US its like comparing person who is illegally crossing the border from Mexico side.
 
Different countries different rules. This is the rule that they put in. I am sure they thought about it before they said 5 years.
And what happened in the article may be the unintended consequence of that rule.

US has a great legal system and hence, people can appeal. Imagine someone trying to appeal in most other countries, they might as well wait out the 5 years.

Immigration rules can be strange. I am here in the US and there is no 'you are not welcome' sign here. Businesses are all for H1B and business is still a large and influential lobby group.

Someone said about rules being misused. From the article, it sounds like an overzealous immigration officer rather than any rule. Like commonwealth said, it can be a strange system.

Getting H1b is one thing, making it through the process and living an American dream is another.
You know approx 25% of H1b holders don't get GC and fewer eventually get Citizenship.... Don't know why you would cross border if you have valid visa and you are following appropriate rules?
