if one can file h&c running active
spousal running active
can also file a refugee to get health card ?

what are the consequences if refugee get denied here?

If your refugee application gets denied, your departure order comes into effect and you have to leave Canada within 15 days. If you don't leave, it becomes a deportation order and you will be inadmissible to Canada

You can only control so much. Withdraw your spousal sponsorship and start the custody and divorce procedure. Report any instances where you have proof that your ex has been lying or not reporting savings, work, etc.
