Thank you so much for the advise Nashe_31. I was just wanting to apply for an appeal with the relevant case processing officer but my consultancy firm advised me that usually, they (CHC officers) stand firm with whatever decisions they already made. Making a court appeal is a stronger and better option.

My appeal has already been submitted but I am planning to gather other documents just in case to support my credentials. I am just hoping that my lawyer would really do his best to win my case.

Reference to the court appeal I have made last year after getting the refusal letter. I received already my medical request!!! ;D ;D ;D Meaning the Court has granted my appeal stating that said data they need were actually submitted by me.

I already finished my medicals in February but still waiting for the medical requests of my family. Already sent to the CIC the letter that my family will accompany and other documents including paying back the fees that were refunded (government, etc) and landing rights!! Now it has been 2 months since I've done my medicals and a month since I've sent all the required douments but have not yet received the medical requests for my family. Hope it will come soon...

Wonderful news Shy. So did your case go through the courts or was a decision made before it got that far? What costs did you incur?
 
Hi Pippin,

I received the decision letter May last year that I got rejected because of insufficient data so I made a court appeal through my agency here in Dubai. I spent around 7k AED for the lawyers fees plus an additional of 1500 USD paid to lawyer after my appeal got accepted/won. Very expensive indeed. And the court appeal took 6 months before I got the Medical request.

When u appeal in court and you win.It is like giving a strong reply to the London Visa Officer who rejected your file.I have mentioned specifically London visa office because most of the refusals are happening in London Visa Office.

They hold your file for couple of years and then Visa officer rejects your file.Was he sleeping for so many years that he couldn't identify mismatch of duties earlier.?

If u feel your are right and you have money to fight then you will come as winner.

My file was rejected because they did not calculate my points properly.However,My visa office was Buffalo and couple of strong emails to the visa officer with proof of my education and other information ,my file was reopened very easily.In one week,they sent me a letter that my file has been reopened and as of my writing I am through with immigration.

In the GCM notes she specified that case was closed because degree was not not provided earlier but now degree has been provided so case has been reopened etc.The matter of fact is that everything was provided to the office when I sent my documents.She did this to cover herself.The point is that if you are right then there is no point in being scared.Go and fight in whatever way works for you.

My advice,prepare a cover letter explaining everything in it and attach all documents to back up your cover letter.

Break points which visa officer has awarded to you after that specify the points which you should be awarded and other information as well and send it to the visa officer and mark a copy of it to the Immigration minister, jason Kenney.He will not look at your file personally rather his secretary will look at your file and she/he will try to get in touch with the immigration officer.This route is going to be quicker and least expensive of all.
 
Hi, I have the same problem, I am a June 2010 Applicant and got a refusal letter, It says that the JD is not suported by the employers letters which I think is stupid, I made myself the letters and have my previous employers signed it, should I ask for reconsideration?? I don' have money to go to the court, how could I ask for reconsideration??
Please advice.
