Hi my names Steven and me and my girlfriend have been going through some problems with trying to happily live together inside of Canada and had some questions someone could possibly help with .

She was living within Canada for about 7 months and filed for a Extension and everything was fine we where working on everything else she had to do but unfortunately she had an emergency back in the states and had to travel back for about a month to deal with everything when she tried to return to Canada the Canadian customs stopped her and didn't allow her through because they did not believe she would be returning to America at all and had no ties , the man at the boarder told us she needed a PR Card , Study permit/work permit or Get yourselves married.

Now since she is not aloud back in Canada right now till she has one of the above things what would be the proper way to go about this iv'e read 100's of things online about the easiest way is doing the marriage , we are 25-28 years old and been together over a year so marriage would be legit just wasn't sure how we should go about it .. do I travel there and get married and we both come back happily or is this PR card a better way to go . she has 1 job opportunity here as well but would the marriage actually be easier for us .

As you are not common-law or married, you cannot apply to sponsor her for PR. Go get married in the US and then sponsor her.

Unless the job offer qualifies under NAFTA, the employer will need an LMIA to hire her. The LMIA process is long, expensive and has strict requirements, so it is extremely difficult to find an employer willing to do it.

For sponsorship questions, move over to the Family Class section of the forum.

Thank's for the quick response , Just one more question about going over there to marry her , would I just travel over there when I can and we get married and sponsor her while I'm still there visiting and just come back together or would the process be so long that I should come back to Canada alone and sponsor her while I'm in Canada after iv'e been there and got married.

She could try to enter with you after getting married and show proof that you guys are applying for sponsorship but no guarantees. If she got an unhappy border officer, she could even end up with a one year Exclusion Order. Given that she has been refused entry already, I would suggest that you guys get the sponsorship app submitted before she tries to enter Canada again.

Awesome man thanks , now when you mean submitted sponsor ship app should I stay In america with her while we do all this ? cause I no as a visitor i'm only aloud there for 5-6 months I believe ? And would we get some kind of proof like papers showing the sponsorship app is submitted or complete

Assuming you are a Canadian citizen, you can apply while in the US.

It takes around 2 months to get a letter confirming receipt of the app. Until then, you can show the payment receipt and the mailing receipt. CBSA may be able to see the app in the system before you get an acknowledgment.
 
I am yes a Canadian Citizen , Iv'e researched online that the whole process would take 10-12 months for the sponsorship to fully complete so if we actually waited for the full completion would that assure her a no problem entry to Canada other then just proof that we have filed for it , I'd hate to not have the official papers proving her sponsorship before we tried to cross the boarder just because yes she was denied before .

Outland American apps generally take 6-8 months. Once she has PR approval, there would be no issues for her to enter and land as a PR.

Provided the PR app has been submitted, she should be able to enter while it processes. CBSA is generally lenient with those who show that they are following the rules to legally live in Canada.

A little more optimistic, majority US applications will be fully processed and approved in 4-5 months, based on the cases history on this forum.
