****Getting married in Korea and coming back to Canada****

Hi Everyone, my first post here, so please bear with me.

So my girl friend (now fiance) and I are engaged, and planning to get married in Korea. Now, after we get married in Sept 2014 in Korea, she is going to have to come live with me in Canada. I've gathered that I need to sponsor her for permanent residency...but after that I am really clueless.

1. I am planning to go to Korea in April 2014 for 2 weeks to file and register the marriage in Korea, and go back again in Sept 2014 for another 2 weeks to do the wedding. My fiance will stay in Korea until Sept 2014, and will come back to Canada with me after the wedding. Can I get the immigration process started in April 2014? or is it better and safer to start it after the wedding in Sept 2014?

2. If we choose to do inland application, what should my fiance tell the CBSA when entering Canada in Sept 2014? Visit? I guess? then she would get approx. 6mths for visitor status? Can we start the immigration process right after in Canada?

3. If we choose to do outland application, who should we contact to find out the details?

4. What kind of documents I need to bring from here to submit the marriage in Korea?

Feel free to educated in me in these things, I feel like I have a lot to learn about this before I get married so we can make this process as smooth as possible.

1) As far as I understood, you'll marry in April and celebrate it in September? If you are officially married in April, you can start with the sponsorship. Just remind that is good to send photos of the marriage and celebration. In my case, I got married with only 10 people and then, we went to a restaurante/club.

2 and 3) We did outland. My visa office says 14 months, but it was done in 9. If you have the option to go outland, it's faster. On the CIC website, they inform you all the documents, including a final check list.

4) Sorry, I don't know what you need to get married in Korea.

I think you would be much safer to begin the process after the wedding. Those wedding photos and the fact that you had an actual ceremony will help convince the Visa Officer that your marriage is real. The genuineness of your marriage will probably be a concern for the VO in your application since you will be applying so soon after you are married.

You can still do the outland application, even if your wife is here in Canada. It's faster.

Your wife should tell the CBSA officer that she understands that she is only here to 'visit', not "live". She should have a return ticket to prove she is willing to return at the end of her six month visitor's visa. Once she is here you can apply to extend her visitor's visa so that she can remain in Canada with you while her PR application is being processed. Assuming that she is otherwise admissible and you can support her here, that extension will probably be granted.

I don't think you need to bring anything. I married a Korean in Korea. Any documents they needed from me I got from the Canadian Embassy is Seoul.

Technically you can get it started in April 2014. The registering of the marriage is super quick and simple, and within less than a week the marriage certificate is released that you can pick up from any govt office or have your wife download it.

It's usually better to wait until the full ceremony so you have lots of proof/pictures its a valid marriage, but it's up to you.

Note that if she does Inland, she should prepare to remain in Canada and not leave for any reason, for up to 2 years.

Outland app would be processed through Manila. She could realistically expect full PR status here in less than 1 year. As a visa-exempt traveler, it should be easy to retain valid visitor status in Canada for that entire time.

4. What kind of documents I need to bring from here to submit the marriage in Korea?

First, you need to bring your passport and $50 Canadian (or Korean won equivalent) to the Canadian Consulate/Embassy in Korea, where you will sign a declaration stating you are single. Make sure you check the hours this service is available, as when I did it they ONLY did this in the morning and stopped sometime around noon.

Next you get that declaration translated into Korean. This can be done by a family member or something, doesn't need to be super official.

And last, you take the translated declaration to your local "gu" office where they register marriages. Your wife will do all the talking, I think you maybe have to sign your name once, and that's it. You don't have to say anything, the entire thing is a bureaucratic process done at a teller window.

Then you would get that marriage certificate translated into English for submission with your PR app. This translation needs to be certified/notarized.

I guess she will have to purchase another one way ticket from Canada going back to Korea to prove that she would be going back to Korea since she will be coming here as a "VISITOR"? or does she have to get a refund or cancel the returning ticket and purchase round trip ticket from Korea again?

2. Do you know anybody who can do the certified/notorized the marriage certificate translated into English? any recommendations?

3. If we choose to do outland app., I can complete the form here in Canada, and send it to Manila office directly? or does it have to be sent from Korea?

When she comes here after your wedding, she will need to show that she has a ticket to get her back to Korea. Once she is here you can apply to extend her visitor's visa. After you have filed the application to extend her visitor's status, you can cancel her return ticket and get a refund.

Rob TO can probably help you here as he recently went through this process. It was too long ago for me to remember how we did that, lol.

You complete the forms here, mail them from here and it goes to Mississauga for sponsorship approval. Assuming they approve you to sponsor her, CIC sends the file to Manila.

In addition to the marriage certificate, you also need to have the Korean police check and family registry docs (and possibly another one) translated into English. So it's best to do them all at once.

For our translations, we used a lawyer/translator here in Toronto. For 3 pages needed translation, he charged us $100 total. If you're also in Toronto i can give you his contact info. If you're looking for someone in Korea or another city, then I can't help.

As I said, make sure you've confirmed and gathered ALL the docs you need translated at once, so you get bulk pricing.
