I had a legal question about applying for FSW (when it reopens in may). Me and my husband applied for asylum in US last december, we had our office interview in february and got referred to court. Our case is still pending. We haven't gotten a work authorization yet (EAD) , and won't be eligible rill mid-june (best scenario).
My Questions:
1. Can we apply for FSW ? or is there some law (or a disposition even) that precludes asylum applicants from applying for any other type of immigration in Canada. My Husband and I usually score high on the FSW eligibility test (yes, i've done it a few times).
2. I read that there's a 2004 pact that prevents those denied asylum in the US from applying in Canada. How about those with pending applications?.

1. Yes - you can apply.
2. The Safe Third Country Agreement prevents you from filing for refugee status / asylum in Canada. It does not prevent you from applying to immigrate as a skilled worker.
