Hi i applied in FSW back in december 2014... now applying in TRV. i have not got any news from FSW application. DD has not been cashed yet. now i need to go canada, so will apply for TRV. should i mention abt my PR application? will this cause any problem getting my TRV permit?
please urgent help is needed.
 
Hi,

Your FSW application is already on the CIC database. You must mention about it (regardless of the stage it has reached) in your TRV application. You must be truthful always

An aside: Recently, a few TRV applicants have been given 5 year bans for misrepresentation for failing to disclose previous visa refusals

Thanks a lot for your reply. Actually i heard a fsw applicant got refused in TRV when he told VO that he applied in FSW in Canada. Although he got refused in TRV but eventually got the fsw PR later on. that y i was asking what to put in the TRV question -

" Have you previously applied to or remain in Canada? "

TRV refusals are mostly because the applicant is unable to prove strong ties to the home country ie on assessing the balance of probabilities, the VO must be convinced the visitor will return to his/her home country

My advice is to be honest :)

I am in the same situation. Could you please tell me what did you write in the form to explain your situation?

Did you apply for a single entry visa? Or they gave you the single entry visa because you have FSW application pending.

hi there. I have also applied for FSW back in Dec 2014. My DD is cashed already but I haven't got the file number. Now I want to apply for TRV to attend my conference. Can I apply for visit visa while waiting for immigration petition? Can they give me a visit visa as | am already waiting to be an immigrant.
Another thing, will USA visa refusal in past have any bad impact on my application?

Hi,

You can apply for a TRV to attend the conference.... be sure to provide strong reasons to return to your country of residence after the visit + strong ties to your country of residence.

You must mention (in the relevant sections of the TRV application form) that you have already applied for FSW immigration + your previous US visa refusal (and refusals for any other country, if applicable)

It's not possible for anyone to say whether your US visa refusal will have a negative impact or not on your Canada TRV. The best way is to be honest and provide an explanation rather than a one-liner answer in the TRV application form. If you have traveled to countries like the UK, Europe, Japan, Australia, etc (visas are not easy to get) then you can leverage this Travel History to your advantage

WHat strong ties I can show? My kids and husband are not applying with me. and I am working here. DO you have any idea what else can be a strong tie?
Other thing, what else do I need to tell about my USA refusal? The reason they gave was my immi petition filed by my relative. I am afraid that if I will tell this thing that I have my US immi is also filed, it might have a bad effect on my FSW application.
What do you suggest?

Hi,

Strong ties could be:
a. Family ties for example your kids and husband + other close family, if they live in the same city/country

b. Employment (if you are employed..... then employment letter + salary slips + letter from your employer permitting you to attend the conference + if your employer is paying for your visit, etc).... if in business then all relevant registration and tax documents

c. Financial ties (investments, savings, shares, etc)

d. Property (residential/commercial/land ownership).... or if you have a lease/rental agreement for your accommodation

e. Legal Ties (if you have legal obligations).... or Social Ties, if you are a volunteer/member of a voluntary organization


Are you applying to immigrate to both the US and Canada simultaneously?

Do keep in mind, that US and Canada have access to immigration databases.... and it would best for you to be honest for your FSW PR and TRV.... rather than risk a ban later for misrepresentation/failure to disclose facts.

My brother in law has filed for our immigration petition way back in 2008. It is still pending. The visa officer gave me the reason that while waiting for the immigration decision, I cannot apply for visit visa to US.
Should I mention this in detail of visa refusal in TRV form? Would it have any bad effect on my Canadian immi? I think I can apply for immigration to multiple countries simultaneously as status is not yet known for US or Canada. Is there any such rule in Canada that I cannot apply for Canadian immi while waiting for US immigration to be finalized?

You must mention about any visa refusal and the details in your TRV application.

Each visa application is evaluated on its own merits, your individual circumstances and the documentation you submit.... no one can say how the visa officer will assess your situation

You can apply for immigration to multiple countries.... if you're lucky to get two/more then, of course, it does become a juggling act to maintain PR status in two/multiple countries
