Hi All,

I have come to canada on Jan-2010 with a work permit valid which is valid till may-2011, now i would like to apply for PR in Canada as i have got a Job offer from a canadian company, please advise if i can file my PR application in Canada itself or i will have to apply it back in my home country.

If i can apply from Canada what should be the apprx. time to getting the PR.

hi Bisu,

If you are still in Canada with your work permit since January 2010, you can apply from there. According to this forum, the average time in getting a PR is 6-18 months. I believe you might get it faster because of your work visa.

Can you please advise on the Visa office to be opted by me "Canada" or "New Delhi" India, i should opt the one which will be faster in processing.

hi Bisu

I would suggest your visa office to be Canada since you're physically and legally already there. I just don't know if they can process applications faster compared to the New Delhi VO.
 
Hi Upp,

Even i am planning the same, but will there be any problem if it gets delayed and cross May 2011. Coz my present WP is valid till May 2011 only, do you also have any idea on the WP renewal process ( I mean the lead time to apply).

hi Bisu,

I don't think it would be a problem because you have been legally there for one year. I've read in this forum somewhere that some applicants don't even have legal status when they started their application and eventually got their PR cards. Even though your present WP is valid until May 2011, the whole process might be done by then. If it's not done by then, just renew your WP so you can work legally while you keep waiting for your application to be finished.

1) Where to file - see p. 24 of the application guide -

a) All applications initially go to the CIO-Sydney in Canada.

b) If approved, you then fille your full application to a local visa office. There is no "Canada" visa office for FSW applications. Applicants residing in Canada can apply to the CHC-Buffalo, however, you cannot file there until you have been living (legally) in Canada for at least 1 year. You can send your application to New Delhi - which lately has been processing applications faster than Buffalo.

2) If you are applying as FSW2 (arranged employment), you should be concerned about timing. One of the requirements of FSW2 is that

"* your temporary work permit must be valid both when you apply for a permanent resident visa and when the visa is issued."

So get your initial application in ASAP to the CIO, and plan to send it to ND. Hopefullly, for you, they will continue processing quickly...

I am confused, however. In the Foreign Worker forum, you state that your TWP is valid only until Nov 2010... which is it?

Its a typo there, my WP is valid untill may-2010, are you 100% sure that if i need to apply in Buffalo Visa office i will have to stay in Canada for 1 year, i am a bit confused here. The CIC says " if you are lawfully admitted to that country for at least one year" and i am lawfully admitted to this country for two years i.e from June 2009 to May 2010, how ever i am staying here only since Jan -2010. Please advise.

No, not 100% sure. You know, the wording has changed, I think you are right. I was remembering older rules, sorry. Can someone else verify?

Still, I'm not sure that Buffalo would be the best choice - it is slower, and if you get called for an interview, you would have to be able to travel to the USA (difficult for some)... but you have your reasons, I'm sure.
