Hi all,

I am creating a profile for EE and have a common-law partner that is a Canadian Citizen. We are both currently living together in Canada and she also has a sibling that fits the profile to earn an extra 15 points living in Canada. I would like to try and claim these 15 points however i'm not sure if i qualify.

I am wondering how i answer the following when filling out my profile.
  • What is your marital status? (I thought common-law)
  • Will this person accompany you to Canada? (she already lives in Canada, with me, so not sure if this is a yes or no)
  • Do I have a relative who is a citizen or permanent resident of Canada? (i put down spouse/partner however it talks about if my partner has a sibling here. should i put down brother/sister instead?)
I realised that if i select "yes" in response to the accompany question, it asks for her details including family, education and work experience. If this is the correct way, I feel like there is no need to fill out education and work experience as i get no extra points. Thoughts?

any advice would be greatly appreciated, thanks.

You cannot claim the 15 points.

Since your common law partner is Canadian, you cannot claim any points through her (either for her education or work experience or siblings).

To claim the 15 sibling points, the sibling living in Canada would need to be your sibling.

Wondering if IRCC spells this out on their website?

Also I imagine that i would say i have common law partner but they're not accompanying me to Canada. Would i say there is 2 of us for the financial portion or just 1?

Note If your spouse or partner is not coming with you to Canada, or they are a Canadian citizen or permanent resident, you will earn points as if you don’t have a spouse or partner.
