Filling application during legal separation

I am legally separated and the divorce proceedings are going which may take another 2 years.
Does this legally separated status would affect the ITA

You can apply as Divorced and can submit the acknowledgement letter that you received from court.

Can I submit application as divorced as I have only separation letter with me and the court shall complete the proceedings in two to three years.
Is not true that I had file reply to CIC within 60 days.

You can file with that. We do this with our clients and they have PR as well.
