filing for divorce and pr status

Hi everyone,

I am a Canadian citizen and I am sponsoring my wife to obtain her PR status in Canada. She expects to get her PR next summer.

My and my wife got married in October 2014. We were together for a year and the main reason that I got married at age of 24 was because her PR application was rejected and her work visa was expired. Since then, there was a lot of tension between us in terms of our ficiancial situations and family relationship. I do not take marriage lightly but I feel like this relationship is driving me insane and suicidal

I am talking to my divorce lawyer to understand my legal rights. If I file for divorce now, will she face deportation back to her home country?

If you get divorced this cancels your sponsorship as she is no longer a member of the family class. However, if you only got married for her PR then that is a marriage of convenience and is against the law and thus she is not a member of the family class to begin with. Either way this is misrepresentation if you go through with it.

So yes she might end up deported, depending on if she ends up with a removal order or goes willingly, that's up to the CBSA/IRB. She MIGHT be able to appeal it on humanitarian and compassionate grounds but that is very difficult to win.

If you separate or divorce, YOU must inform CIC and withdraw the sponsorship application. If you don't, then you would be misrepresenting, which is a criminal offence. You will also be held to the three years financial support Undertaking. Bad things will happen....
