Hi Sir /Ma'am,

Good day! I want to ask for your advice, my fiance have his visa for PR approved and going to Canada soon, how long does it takes for us to wait to get married? And can he stay to Canada for 2-3 months then come back in our country of origin to get married? and he go back to Canada and sponsor me as spouse?

Have the two of you ever lived together, at any point in your relationship, for one year or more? If you have NOT, then you and he can get married as soon as he lands.

Once he lands as a PR, he can immediately leave and remain out of Canada for up to 1095 days (3 years).

Were you included on his application as his common-law partner? If not, and he lands without declaring you, then he can never sponsor you.

Uh oh...

After reading through your other posts, it appears that you are still a PR, even though you have not been in Canada for a very long time. This, compounded with the fact that your fiancee cannot land as a single person, since you are a common-law couple in the eyes of CIC...makes your (AND HIS) situation a real mess!

His application is Family Sponsorship, applied by his mother his whole family is in Canada. I'm not included in their application. If we get married, what are the chances that I can come and live in Canada with him?

And also my Family is in Canada too. I was a PR Card holder when I was 14 years old (2005), I came to Canada stayed there for 4 months and came back in our Country of origin to continue my study and work too. I haven't apply for PRTD because I didn't meet the RO.

Can you please advice me what is the best thing to do. Thank you.

Lying on the application is not the best thing to do.

If he is included as a dependent, then he needs to be removed because he no longer qualifies since he is in a common-law relationship. (Some exceptions may apply, you'll need to research that a bit more)

Yes, because you are not eligible to be on his application since you are his common-law partner...which means that he isn't even eligible to remain on his own application, since he no longer qualifies.

Just wanted to add that if he decides to land anyway, ignoring the fact that he has represented himself, (CIC takes misrepresentation VERY seriously) he may jeopardize his mother's' PR as well, if she is a PR, since she would obviously be aware that he has a common-law partner.
