And I think the DUI may need to be disclosed because of Question 6b on the same form where it asks if you have been convicted of a crime in Canada or any other country. I'm not sure of all the OP's details but sounds like his wife was actually convicted for DUI and in the US I believe that is considered a crime?

oh yes definitely, i believe it's a criminal offense, so it would need to be disclosed. most likely it will come up on the fbi record.

i believe you would have to apply through the california bureau of investigation (i saw someone reference this recently), or the state police department. i'm sure you can google it.

Unfortunately her case has a few red flags so it might take awhile. If it is possible for you to move there for awhile, that might be the best thing if you don't want to be separated long.
