Family sponsorship (Canadian wife & Brit applying) - ability to work

Hello all

Our application goes back to November 2018 and we have still not received any update other than “medical received”... it says “in process” but doesn’t suggest anyone has picked up the application yet (worryingly but perhaps not a surprise to many of you on here).

As a teacher and living in Dubai, my teaching contract is coming to an end in early July. Thus my visa will be invalid in Dubai too. My pregnant wife and our daughter (both Canadian nationals) are likely to return to Canada very soon with my hope to follow them this Summer to “visit”. However, if we take the 12 month suggestion of how long it’s going to take to get an answer it would mean we are left without money coming in until at least November (pregnant wife can’t work and I won’t have a visa yet...) - so does anyone know the answers to these questions:

Can I get a temporary working visa in Canada whilst I wait for the spousal visa to be granted?

What happens to our application if we all move from Dubai to Canada (me on a visitors visa)? Do I have to declare something about our change of circumstances?

I need to work to support the family and the new baby on the way. We can’t afford to wait it out as there’s no guarantee that it would come November (& I’m worried that if we do have to declare change of circumstances then the application date will be delayed even further...)

Any idea who we could talk to for advice (lawyers are extremely expensive!)

Is your application being processed at the London Visa Office?

You cannot get a temp working visa on an outland application and you cannot work as a visitor. The only way you'd be able to work would be if your independently qualified through some sort of economic stream that would allow you a work permit, which I doubt would be feasible.

No. You'd have to apply for economic immigration or a work permit, each of which are likely to take months to approve.

You need to update your address.

You would need to update on the birth of a child as well.

Lawyers ($$$$) or consultants ($$$), both of which won't be able to do anything but charge you a lot of money to tell you "It's a waiting game," or you can read threads here.

Unfortunately, this is the case with spousal sponsorships. It takes 12 months, or longer. Only Americans seem to get quicker processing.

As said above, you do not qualify for a work permit by virtue of having applied for PR.

Options for getting a work permit and being able to work before you are a PR are limited. They include:
- Obtain a job offer and approved LMIA from an employer in Canada so that you can apply for a closed work permit.
- If you are 30 years old or under, submit a profile for the IEC / Working Holiday pool and hope you are selected.
- Not a great option. But once you are in Canada as a visitor, you could withdraw your outland application and apply for PR from scratch using the inland process. You can then include an open work permit with the application which will be granted around four months after the full application package is submitted. Downside of this is that your application processing time will start from scratch as well.

Sydney is not the processing office, that's the intake office. Files are usually transferred to a respective Visa Office (in your case London Visa Office in the UK or Mississauga On). I do not believe we've seen a file processed to completion out of Sydney but I may have missed some along the way.

Have you started looking into what it will take to be certified to teach in Canada? Different rules for different provinces. Recommend you start the research now.
