Hey all,

Question: my Fiance and I have applied to extend his stay as a visitor. If he gets denied (for whatever reason) will they respond and ask him to leave right away? (if past his original visa date) or how does that work? Is it common that the stay is extended and it's no problem? He provided proof of income and current visa.

I think they will give you 30 days to leave.

Whether he will get extension or not largely depends on numerous factors such as country where he is from, travel history to Canada, etc. From what I see in this forum, many are granted but not everyone. Since you have already applied, you will have to wait and see.

They usually say "immediately", because by the time they reply it is likely that the person's status has already expired so they are now in Canada illegally. You want to go within 30 days, because at that time, the departure order turns into a deportation order.

Thank you, that makes perfect sense. The thing is we are getting married... :D

So if for example he is told to leave and we get married right after, will that be enough time to submit his paper work and for him 2 stay?

It is a hard question to answer. If you have gathered everything before marriage and just waiting for certificate (don't know how long it takes) and photos, maybe you have enough time but if you are still collecting evidence, it might not be enough. It takes months to gather all the evidence for many cases. And in regards to 30 days, I would assume it starts from the date the rejection notice is issued, not from the date you receive the notice.

Are you applying inland? If he receives no extension, after the date the current permit allows him to stay, he will not have legal status. I do not know sending application will automatically allow or guarantee him to stay. But I am not familiar with the inland process and you should wait for senior members to respond. But for outland process, sending application does not change the decision of denial.
