Express Entry Profile submission as common law partner

Hi, We (me and my girlfriend) do plan to submit our express entry profiles. I have a score of 435 and she has 362 individually. However, if we apply together as common law partners score is 435. We are from India and not sure whether we could apply together without being legally married to each other. Any suggestions?
