Hello,

Greetings from Mumbai. I wish to immigrate to Canada along with my son who is 13 years old. Is it possible to immigrate with only one parent. I am not divorced. But my husband has his work set up here and he cannot come with us. Hence it is only me and and son. How feasible is it?

You will need authorisation on an affidavit from your husband that he allows you to immigrate with this son with no conditions whatsoever.

However, I would recommend that you all 3 get a PR, your husband can come back after doing a soft landing and work in India or wherever he wants, this would have you less explaining to do.

But then he will have to appear for IELTS and go through ECA and all. Further he doesn't wish to work in Canada. So will he get PR even if he doesn't wish to work in Canada ?

Yes, he can get a PR as your dependant even if doesn't wish to work in Canada and yes he will need to go through IELTS and ECA. IELTS is compulsory, however, ECA is not mandatory if you don't want to claim points for his education.

If you plan to apply alone, though you are married, you will get points as if you are applying as a single.

However, you will need to explain and prove with documentary evidence why your husband is not accompanying you to Canada. The reason can be as simple as will not get enough points by applying together to as complex as he doesn't want to work in Canada because for so and so reason. But do remember, you need to be 100% honest with your application and try to leave no grey area.
