Hi,

I have run into a few fellows who come up on the Season Work Program and have overstayed their dates of departure. They appear to want to straighten out their status (they do not want to marry by the way) and they appear to be nervous about the process.

What would be the steps for these men who have no status (visa or work permit) at this point? By the way, sme of these guys have been here as much from a few years to a few months.

To "straighten out their status" they probably need to leave Canada. As far as I know they will not be able to obtain a new visa from inside the country.

If they have stayed longer than 90 days from the expiration of their visa, they will have to leave the country. If they leave voluntarily, that will count in their favor for a future application. If they get a removal order, it will count against them.

If they have stayed less than 90 days (doesn't sound like it), they can apply for restoration of status.
