I obtained my PR and arrived in Canada in 2006. In 2011, I applied for citizenship after spending the required time in Canada. However, while waiting for my citizenship appointment, my PR expired, and I applied to renew it. Unfortunately, due to an emergency in my home country, I had to leave without receiving either my renewed PR or my citizenship appointment.

After being away from Canada for more than five years, I learned that my PR status was still active, but I was not allowed to return. I tried to contact CIC and find a way to continue from where I left off, but was unsuccessful. In 2020, I consulted a lawyer to check my status and learned that my PR status was still open with no objections or restrictions.

In 2021, I applied for a visitor visa and reapplied in 2022, as there was a significant delay due to COVID. They informed me that all applications before September 2021 needed to be resubmitted. I received my visitor visa for my first application, while my second application required me to voluntarily cancel my PR to proceed.

My question is, if I travel to Canada with my visitor visa, will I be stopped at the airport due to my PR status? Additionally, is it possible to reopen my old PR case?

I want to find the best and fastest way to reside in Canada again. I have also applied for visitor visas for my two young children and plan to apply for PR status for them. Any advice or help from a lawyer would be greatly appreciated.

There are no lawyer on this forum. If you want legal advice, you'll need to hire an immigration lawyer.

No, you should not be stopped at the airport if you travel to Canada with visitor status. You are no longer a PR and are only entering as a visitor. Make sure you have a return ticket since you are not allowed to live in Canada on a TRV. To be clear, all the TRV does is allow you to visit here as a tourist. That's it.

Your PR status is gone. You were required to renounce PR to get the TRV. You can't get your old PR status back. It's impossible to reopen your old case. To get PR again, you will need to qualify, apply, and be selected through one of Canada's current economic immigration programs (i.e. Express Entry, PNP, etc.). Basically you'll be starting again from scratching in applying. You would include your children in your application and, assuming you get PR again, they will get it with you.

As already said, you renounced your PR. When you come to Canada, you come as a visitor. You cannot work or access services. You cannot live in Canada.

When were your children born? Did they get their PR at the same time as you? You may have renounced your PR, but your children if included in your original PR applications may still be PRs. If they are PRs then they cannot travel on a TRV, and their TRVs will be refused.

It sounds as though you may have been given a TRV in error. There is a good chance that was cancelled electronically after it was discovered that you were a PR. May be incredibly difficult for your children to get TRVs if you are a PR that isn’t compliant with your RO. There will be concerns that they plan on remaining in Canada. As visitors in many provinces they may not qualify for healthcare or to attend school without a permit.
