Hi. I have a general query.

I had a canadian PR which got expired in Jan 2011. I did not complete my stay requirement in Canada during the time. The weather did not suit my parents and because I was a dependent member I came back to Dubai with them. But now my husband and I are keen to relocate to Canada. I had applied for immigration to Canada, however, I have received an email from immigration lawyer asking me if I have tried renewing my PR. The reason being that Canadian authorities still have my name present in the system. I tried going to Canadian embassy here but I did not get any help/assistance. Also the site only tells me that I can apply for PRTD and see if it works. Also then again I am told it can be rejected or accepted because it is dealt on case by case basis. The other option the lawyer has given me is to renounce my existing PR and try applying as a new entry. I am worried if it gets rejected again.

Hi

Agree with scylla. You have no chance of retaining your PR status on H&C grounds. You need to renounce your PR status and apply from scratch. Your previous status will not effect a new app.

Other than renouncing your PR and starting over again, your only options are to apply for a PRTD (and you can expect that to be refused and the process of revoking your PR started) or to attempt to enter Canada through a land border (and I would expect them to start the process of revoking your PR as well). I am assuming from your statement that you were not married during your time in Canada and that your husband does not have a PR, so there will be issues for him entering Canada to live. If he is not a PR, there is no guarantee he will be allowed to enter, nor stay for an extended period. If you enter via land, without being reported, you won't be able to sponsor him until you meet the residency requirements (2 years). You can appeal the revocation process, but it's long and drawn out and your chances of success are extremely low as cold weather isn't a good reason for H&C. Then there is all the issues related to SIN cards, drivers licenses, health care, bank accounts, etc....all of which usually require a valid PR card to receive, which is a whole new set off issues.
In reality, renouncing your PR and starting over with your husband is probably the fastest way to come to Canada, but keep in mind, it's still cold here. That much hasn't changed

But if your husband is Canadian citizen, you might be able to prove that you maintained your status as a PR. He can also sponsor you for immigration from scratch while living outside Canada and enter Canada by himself.
