Hello everyone,

I am seeking advice regarding my current employment situation and its impact on my Ontario Immigrant Nominee Program (OINP) application. I will try to summarize the timeline and current challenges.
  • I lost my status in Canada in March this year, which required me to stop working.
  • In March, I applied for permanent residency via Express Entry, but my application was refused in July.
  • After the refusal, I approached my employer to ask if they could help me with an LMIA to apply for a new work permit. Unfortunately, they said they could not provide support and requested my resignation immediately, stating that they could no longer hold the position for me.
  • I declined to submit a resignation, as I believed it was unnecessary given that the employer could have terminated my employment due to my loss of status.
  • For about a month, I did not hear from my employer. When I followed up, we had a call to discuss the LMIA challenges. I understood their position and requested a job reference letter and employer documents for future applications.
  • I received the job reference letter today, but it does not specify the end date of my employment.
Separately, I also received an update today from the OINP regarding my foreign worker stream application submitted last October. They requested that my employer to revise my wage, as it was below the median for NOC 21310 in Toronto.

The issue is that my employer has repeatedly refused to confirm in writing that my employment has ended, and I do not expect them to revise the wage or support my employer-based provincial nomination application. My assumption, based on their request for a resignation letter, is that I am no longer employed by them.

The province has given the company five calendar days to submit a new job offer with the revised wage. Honestly, I do not expect them to comply.

My questions are:
  1. What happens if the employer refuses to submit the revised job offer to the province?
  2. How should I proceed with my OINP application under these circumstances?
  3. Is there any way to use my existing employment documents or job reference letter to strengthen my application, despite the lack of employer cooperation?
Any advice or guidance from someone who has been in a similar situation would be greatly appreciated.
