1% is illegal ? ( from India ??? ).... If you got a visitor visa , extended stay legally , apply spousal sponsorship inland and not back to your country , is it also abuse the immigration system ?

As long as you maintain legal status, no. It's the people that don't maintain status that are the problems or people that lie to get status.

The situation you described is legal. With an inland sponsorship, you can stay as a visitor until a decision is made.
