Hi,

I have a closed open permit and I applied under CEC and already was assessed, but my current WP expires only on April, 2014. In a normal situation I could only apply 4 months before my WP expires (January, 2014), but in case my contract is terminated before that, could I apply before January for an open WP?

Please, help me with this!!

Thank you!!!

You can but it is not guaranteed you will get one. You should enclose an explanation why you request open work permit before the closed one expires, several forum members already tried that and got the open work permit.

You either have a closed work permit(tied to an employer) or an open work permit - which is it?

No, it is not possible to apply before January for an open work permit. Note that you will also need the acknowledgement of receipt(AOR) email from the visa office processing your application to apply for the bridging open work permit.

If you want to apply before January, it will be a closed work permit. You will need the employer to apply for and obtain a positive labor market opinion(LMO) from HRDSC. With the LMO, you can apply for a closed work permit.

Are you concerned your contract could be terminated?

Since you have the AOR I would suggest you apply for the BOWP. As the other OP has stated, others in the same situation have had the BOWP approved for the same reason. Try to provide as much supporting documentation as you can. Good luck.

Thank you all for the help and info.

In case this happens to me, I will gather as much documents as I can!

Just one more question, in case they deny my request, I can always apply on January again, is that right?

Correct.
