Hi There,

I am applying to sponsor my parents. My dad will be the principal applicant bringing my mom along. My brother who is 29 years old still lives with them as they support him through university. Should he be including him as his family member even though he does not plan on accompanying them to Canada? They note that children under 22 but I just want to make sure we fill out the application correctly.

Has your brother been in education continuously sing he was 22 or has he returned to education after a gap?

Definitions of dependent child (types A, B and C)

TYPE A
The child is under the age of 22 and is single (not married and not in a common-law relationship).

TYPE B
The child has been continuously enrolled in and in attendance as a full time student at a post secondary institution accredited by the relevant government authority and has depended substantially on the financial support of a parent either:
since before the age of 22, or
since marrying or entering into a common-law relationship (if it happened before the age of 22).

TYPE C
The child is 22 years of age or older, has depended substantially on the financial support of a parent since before the age of 22, and is unable to provide for himself or herself because of a medical condition.


Does your brother fall under type B or C? If not then he doesn't need to be included as dependent.

Note if he does fall under Type B (has been constantly enrolled in university since before age 22 to today), he will need to stay in university until the visas are issued else he will be removed from dependent status. If he doesn't intend to stay in university the next 3+ years during parents processing, then I would just say he's NOT a dependent upfront, even if your parents do support him. Then he won't need to be counted in LICO requirements upfront. Unless of course he wants to get PR also.

Thanks so much for the replies. He he been in and out of the university since he was 22. He took 18 months off to do his military service,. I guess this disqualifies him from being a dependent. I just did not want to fill the form incorrectly
 
Yes - that disqualifies him. He should be listed as a family member but not a dependent.
