8) Do you have a valid job offer supported by a Labour Market Impact Assessment (if needed)?

No, I am Intra Company Transfer (LMIA exempt) and my NOC is A 4163.

Should I write YES ? And then clarify that is LMIA exempt ?
If I say NO, the whole following questions disappear and it doesn't give me the 50 points.
I know the ICT now have the 50 points if they are NOC A, but how exactly to you get these credit ?
The whole calculation seems not to include the option of LMIA exemption ?

What is the procedure here ?

Thanks all.

You have to work for your employer for a full year under that closed work permit and you need a valid job offer of one year after you receive PR.

ICT is indeed LMIA exempt - so for calculating your score the answer should be "yes" (IF you have the requirements that I stated above)

The whole calculation seems not to include the option of LMIA exemption ? Yes, it does. You probably don't qualify.

What is the procedure here ?

Thanks all.

Honest question: Do you ever get tired of answering this question? I've seen you answering this at least a dozen times. :P

My hope is that people will be careful before claiming those 50 points - so people who actually deserve an ITA get a chance.

Of course, so far it hasn't worked out :P

So, you guys seem to know each other but you say two opposite things.

DelPiero you say I have to say YES (if you will be working for the same employer for at least 1 year or more) which I do. Even if I don't have the LMIA.
Ashu you say: No, you should not, since you do not have a job offer supported by an LMIA. You should select NO

So. I work for an employer with a qualify job offer, and yes I will be working for at least one year still.

Ashu I don't know (yet) in the cic application form, but here http://www.cic.gc.ca/english/immigrate/skilled/crs-tool.asp
The option NO my job offer is LMIA exempt doesn't exist. It only allow to say yes or no.

So is the option there in the real application form ?

My understanding is that you're simply calculating your score? - If so you can choose "yes" as it says "if needed" - and as we know LMIA is not needed for LMIA exempt work permit.

The questions are different once you create your profile thus, the confusion here.

Ah, I see the confusion here. I didn't know you were referring to the CRS tool, sorry about that (didn't see the link above). When you actually create your EE profile, you will be asked about your LMIA exempt work permit and whether you worked with your current employer for a year. Not sure why the CRS tool is different. For the CRS tool, delpiero is right.

ok, makes sense thanks for clarify.
I have a technical/logical issue here maybe you can help.

So I love my job and my job loves me, so yes I will continue working where I am.
But technically my Visa expire this Dec 31 2017. So does my contract with my employer.
I was already told by the Company Lawyer that in any case (with or without PR achieved) I can extend my TWP for further 2/3 years after Dec 31.
And the company is going to keep me.

With that being said I currently do not hold in my hand a contract that will last 1 year after I get the PR. Simply because the Visa expire this dec and I haven't applied for the extension yet. Why ? Simply because I'm doing the PR and wouldn't make sense. So assuming I get it in ... April my contract will last further 8 months....

So again this is a little circle that I need to figure out.

What is the diligence here ? Should I ask my company to produce a document of intent of keeping me 1yr after the PR achieved ?

You don't have to stay in that job for a year, you just need an offer. You can quit the day after your landing, if you so desire. CIC doesn't care if you stay in your "arranged employment" after you become a PR.

So again this is a little circle that I need to figure out.

What is the diligence here ? Should I ask my company to produce a document of intent of keeping me 1yr after the PR achieved ? Yes, you should, but that doesn't in any way bind you to that company. Both you and your employer can terminate that agreement at any time.

Thank you Ashu but the question comes by itself...

What is the sense of this then ?

I can ask my company to produce the declaration of intent... Will I be asked to upload this later on in the process ?

Yes, you'll be asked to upload this once you receive your ITA.

The sense in this is that not all employers are nice enough to write such letter.

ok I'm writing to HR now...
I don't know what is the usual format for this but I guess they will figure it out with the lawyer.

Thanks both (+1) for the support this topic can be closed.
