Hello,

I am Canadian and my husband is American. We got married in November in USA last year and he came to Canada afterwards in November as well.

We currently have filled out the spousal sponsorship forms but before we submit it, do we need to also extend his stay in Canada? We did not apply for any visas prior to his arrival.

So far, the forms we have filled out are:

  • imm5532e
  • eimm5669e
  • imm0008enu_2d
  • imm5406e
  • imm5476e
We were planning on submitting this but are now unsure if the application will allow him to stay in Canada and if we should be submitting anything else? He does not plan on working while in Canada.

Make sure you submit an open work permit along with the spousal sponsorship application. Regardless of whether he plans to work or not, you want to apply for the OWP to keep his status legal in Canada after you submit the application.

Yes - apply to extend his visitor status as well. If for any reason the spousal sponsorship application is returned as incomplete after you submit it, he will end up in Canada without status. You want to avoid him being in Canada out of status. If you apply to extend his visitor status, this will make sure there's no risk of him falling out of status if the sponsorship application is returned.

In form eimm5669e it asks for all his last 10 years of addresses, do we include the addresses and times where he stayed with me as a visitor?

I only ask because a couple other forms have us placing his current residence in Canada as a visitor.
