Hi everyone.

This is my first post and I would really like some advice. I'm in the UK, I married a Canadian in 1997 and moved to Canada. He applied for permanent residency for me and I understand I needed to live in Canada for 5 years to receive it. I lived in canada from 1997 to December 2003 in which time I had to children. Before I could get a Canadian Passport, the marriage failed and I came back to the Uk with my children. Now after all these years my ex and I want to get married again and I want to move back to Canada. My question is would he have to apply for me as a sponsor again or would the 5 years I lived in Canada count? Any advice would be much appreciated thanks.

You are no longer a permanent resident as you did not meet the residency requirements. After you remarried again, he would have to apply to sponsor you.

To add to that it would have to be an outland sponsorship process

You do not have to live in Canada for 5 years to get PR. If you ever had PR back then, it is now gone because you have left Canada for so long. Your husband would have to sponsor you again. Sponsorship through the UK tends to be fairly quick. You should be able to get your PR within 6 months. During this time, you may visit your husband in Canada or you can stay in the UK.
