I received my ITA few weeks ago. I am the main applicant. My spouse (not married) is accompanying me. We've been living together for 4 years. One of the checklist documents that is generated after filling in all the online forms, is this:

Statutory Declaration of Common Law (IMM5409)(required)
The problem is, I live in a country where there is no such thing as common-law union. The form says at the top:
"BEFORE YOU START, READ THE INSTRUCTION GUIDE"

But where is the instruction guide? I searched all over the internet, and every time it points to http://www.cic.gc.ca/english/information/applications/guides/5289ETOC.asp

This guide states clearly under "Who can use this application" section: "Use this application if you’re a Canadian citizen, Registered Indian or a permanent resident of Canada who is 18 years of age or older"

I am not either. I am applying for PR with my partner. So where is the guide for that?

i am not canadian imm 5409 is valid i guess only in canada
common law partnership are noramally valid only in the area where they were edited it s common.. because it s not marriage and it s not a contract
you only declare to be in a relationship ( and generally you ca cancell it with only notifyig) i t s a simple proceedure that s why. :) it s saying
i swear that i am living with this person :) so just go ahead ! i did it too
