I have a TRV and am currently in Canada. I’m married to a Canadian and we are submitting the Spouse Visa application this week.

I am applying for inland Spousal Sponsorship + Open work Permit

My entry for my TRV last 6 months per entry, so this entry is expiring in February 2019.


Questions :

1. Does inland means that I can not leave the country until my visa been approved?

2. After submitting my spouse visa, does that mean that my stay will be extended automatically?

3. Do I have to apply for any extension of my stay? Do I apply together with the Spouse Visa or it is a separate submission?

You have implied status because you applied for an OWP. Applying for PR gives no status. If however, your application is returned for some reason AFTER your stay in canada has expired you will be out of status and will have to restore your status before you apply for the OWP again

It is not recommended that you travel during an inland processing. Should you be denied entry at the border, your application is automatically cancelled and there is no chance for appeal.

Applying to extend your stay is a separate application

2. your stay is extended (implied status) but not confirmed until you receive AOR......

3. better to apply for visitor visa extension just to be safe and remain in status in case your inland sponsorship + OWP is returned and needs re-submitted........visitor visa extension can be done online or by paper and is a separate application.
