Hello everyone,

I have just received my Confirmation of Nomination letter from OINP. It should have been a pleasing experience, but it hasn't been so...

I received the letter at my old mailing address. Thankfully, the courier guy called me and so I could go pick it up. What is worrying is that I had emailed a Change of Personal Information form to Opportunities.Ontario@ontario.ca and ontarionominee@ontario.ca, declaring the change of mailing address and more vitally, change of family composition on January 4, 2016. I had also updated my EE profile (number of family members changed from 2 to 3 (we had a baby girl)) on the same day. The date I received my nomination electronically was February 2, 2016.

Now that they used the old mailing address, could it be that they never received my Change of Personal Information email? It would be catastrophic because they could withdraw my nomination on the grounds that they evaluated it based on 2 family members. Whose fault would this be then? And what could be the consequences? I had previously emailed another change of personal information several months ago and that one worked fine, so it cannot be related to "I should have faxed or physically mailed it"...

Any ideas, hard facts and support are welcome.

You never received any acknowledgment when you first sent it? So that's pretty strange. I'd always get an email reply from them when I sent that form. Best to follow up with them again to be sure they send the correct information to CIC regarding your nomination.

Maybe they were still on vacation on January 4 (or it was a bad snow day) and they missed your update. I don't think your nomination would be rescinded on the basis of issuing your original nomination with 2 dependents, as you updated them well in advance. This seems like one of those things that "just happens".

OINP generally send a mail acknowledgement when you email them to one of those mail ids, If you didn't receive one, you should have either sent again or called.

Nevertheless, i suggest you send it to them again, with proof that you had already sent it (especially related to the additional family member)

Hopefully, it will be as you say... The only problem could be Proof of Funds since the requirement is different for 3 people. However, my initial proof of funds would cover 3 people as well, so it should be fine in that respect, but I don't know...

If it covers 3 people, no need to worry then. :)

Yes, I have just done that... I forwarded the original email with all date & time stamps intact and explained the situation. Maybe I should have followed up, but it does say on the Change of Personal Information form that they do not confirm receipt, and I am a very busy person so once I did my part, I just assumed all was well...

You have a pretty valid reason to follow up now you know that they sent the nomination certificate to your old address.

I mean I should have followed up when I didn't receive any confirmation of receipt of the Jan 4 email.
 
I wonder if they will

a) withdraw nomination and cancel the application altogether
b) just withdraw and evaluate based on the new information
c) evaluate without withdrawal and take no action since I still meet the Proof of Funds requirement for 3 people as well

Bets are on :)

Follow-up question: It is highly likely I will receive ITA in the next draw which will probably happen on Wednesday. What if I don't hear from OINP about my enquiry until then? Should I accept the ITA or decline it? Since there are unsettled potential issues with my confirmed provincial nomination, I would hesitate to accept an ITA, which could escalate the problem if there is any in the first place.

The best bet is to not accept the ITA until you have clarified your standing with OINP. The responsibility for ensuring that there is no misrepresentation or discrepancy in your furnished documents and application is on you, and not CIC- accepting the ITA in this period indicates that you have the OINP PNP, where you may theoretically not have it. Those would be grounds for misrepresentation.
My advice? Start getting all the documents and paperwork for your application ready- and then once you have cleared this up with Ontario, go ahead and submit the application!

For the record, MCIIT (Ontario) has just replied saying they have added my daughter to my file, and the addition of her does not affect my nomination. A massive sigh of relief!
