Hi,

My father applied PR and have me as dependent because I was under 22 then but I did not joined them because I was declared independent as evaluated by the VO now I'm applying for Student permit.

My question is, in my form is it ask "Have you ever been refused a visa or permit, denied entry or ordered to leave Canada or any other country?" --> yes or no
and 2nd question is "Have you previously applied to enter or remain in Canada?" yes or no

What should be my answer? Somebody told me I'll chose no because it says "YOU" from "Have you ever been" and "Have you previously" which means it wasn't me who applied but my father.
 
Your father was the sponsor. You were the applicant. You have to answer "yes" to the question.

even if I have no knowledge that my father was trying to help me?

so if I was under 22 when my father applied (I'm 35 now) I was the applicant? even if I didn't apply?

You were the one who was refused. Not your father. The application was to sponsor you. You must say "yes" unless you want to end up with a misrepresentation finding and a 5 year ban from Canada.

do you think there was an error when they denied my visa as dependent when my father applied? should we have appealed then? or could we appeal now?

You will need to give some details and the specifics of that case if you wanted any feedback on it.

It actually doesn't matter if there was an error. OP's application was refused 13 years ago. So way too late to appeal or reapply.

Ah yes didn't notice that. And who can remember what the rules were back then for dependents.

Agree it's not at all relevant today.
