Hello All,

I am planning to sponsor my wife
She has 2 childs from the first marriage. Boy 21 yo, part-time student, works; Girl 18 yo, part-time student, works. In My country children starting from 18 yo are not minors.

We are not planning to bring them to Canada, they refuse to undergo medical and police checks. Wife is going to sign an appropriate letter, so they are going to be excluded from the membership for family class.

In this way could I show income to satisfy only mine and wifes needs?
Do I need to undertake these children?

She is going to have a very hard time just writing a letter stating that they don't wish to come to Canada and have CIC accept that.

What the kids SHOULD do, is have the medical exam done, and be listed as non accompanying minors. I know you said they don't wish to come now, but if they don't even do this step, then say, next year change their mind they are forever excluded from being sponsored. They don't require background checks at all because they are non accompanying, only the basic medical checkup.

Trust me, just have them get that far and your application will go much smoother. If they don't then you are in for a very long rough ride to get your wife approved.

There are no financial requirements to sponsor your wife and stepchildren. You must show that you can support yourselves without welfare.

As of January 1st, no child over the age of 18 will be considered a dependent. The 18 year old daughter would still considered a dependent but the 21 year old son would not be.

If your wife's daughter is turning 19 soon, then the easiest thing to do would be to simply wait for her to turn 19, when she is no longer a dependent, then submit the sponsorship application.

If she's only just turned 18 and you don't want to wait to send the app, then it's a little harder. Your wife would need to get a notarized letter stating that she understands that her daughter will be excluded from the Family Class. She should try to show her efforts to get her daughter to have the medical done, any emails or texts they exchanged regarding it. A notarized letter from the daughter confirming her refusal to be included in the app and undertake the medical would be very good.

There are many people who have been in a similar situation, unable to have a dependent child complete the medical and be included in the app, usually when the child is young and in the custody of the other parent who refuses to give consent. Generally, CIC does accept this provided the applicant shows that they fully understand they will not be able to sponsor the child in future.

In Generic Application form there is a place for Dependants to type their names exactly as shown on their passport or travel document, also there is a place to click NO if they do not have passport or travel document. The question is, if one Dependant will pass medical with internal passport (names are given in Russian) and put NO in the box and he is not coming with us, how should we put his name exactly as shown on passport or travel document?:)

I am not positive on this, but I THINK you would put the name as it translates into either French or English. Another member who has has this issue arise before can likely answer this better than I.

Please also be sure to double check the new law and ensure you don't require both children to just complete the medical and checking non accompanying, due to the law NOT being enacted.

Hmmm, very interesting. I'm sure that will affect a lot of people who were already planning their application in terms of the under 19 rule.
